ZOKTO Privacy Policy
Introduction: This Privacy Policy describes how ZOKTO, operated by VYSN Technologies Private Limited ("we" or "us"), collects, uses, shares, and protects personal information of users ("you") in India. We are committed to safeguarding your privacy and ensuring compliance with Indian data protection laws, including the Information Technology Act, 2000 (and the applicable 2011 SPDI Rules) and the Digital Personal Data Protection Act, 2023 ("DPDP Act"). By using ZOKTO's services, you consent to the collection and use of your information as outlined in this Policy. If you do not agree with these practices, please do not use the platform.
Scope: This Policy applies to information collected through our mobile application, website, WhatsApp or SMS interactions, voice calls, and any other modes of communication with ZOKTO. It covers what data we collect, why we collect it, how it is used and shared, your rights regarding your data, and how you can contact us for any concerns.
1. Information We Collect
We collect the following categories of information to provide and improve our healthcare coordination services:
1.1 Personal Data
This is information that can identify you as an individual. The personal data we may collect includes:
- • Identity Details: Name, age, date of birth, gender, photo (if you upload one).
- • Contact Information: Phone number (including WhatsApp number), email address, postal address (for sample collection or medicine delivery).
- • Account Credentials: If you create an account, we collect your username and password (stored in encrypted form). If you log in via OTP, we verify your phone number.
- • Government ID (if needed): For certain services, we might request ID details (for example, Aadhaar or other ID for verifying guardianship of a minor, or if required by law for a prescription).
- • Language Preference: Your preferred language of communication (English, Hindi, Telugu, etc.), which we may store to tailor our communications.
1.2 Sensitive Personal Data
Given the nature of healthcare services, we collect "sensitive personal data" as defined under Indian law. This includes:
- • Health and Medical Information: Your medical history, current symptoms, diagnoses, allergies, prescriptions, ongoing medications, past treatments or surgeries, diagnostic reports, and any other health-related information you or your doctor provide. This can occur via forms you fill, chat/messages you send, or during consultations.
- • Consultation Records: Notes and summaries of your teleconsultations, audio/video call recordings (if calls are recorded with consent for quality or legal purposes), chat transcripts with Doctors, and e-prescriptions provided to you.
- • Lab and Diagnostic Data: Details of lab tests or diagnostics you book (test names, dates) and the results/reports from those tests. These reports may include blood test values, imaging findings, etc.
- • Emergency Details: If you use our SOS feature, we may collect data related to that event – for example, your real-time location during SOS (if shared), the nature of emergency you indicate, and the contact information of your emergency contacts. We also log who your emergency contact is (name, phone) as provided by you, to alert them when SOS is triggered.
- • Payment Information: While we do not store sensitive payment data like full card numbers or UPI PINs, we do record transaction details such as the amount paid, payment method, date/time, and transaction ID for your purchases (consultations, medicine orders, etc.). Card and UPI payments are handled securely by our payment gateway, and we only receive confirmation and partial details needed for record-keeping.
- • Device and App Usage Info: Technical information like your device type (e.g., Android or iPhone), operating system version, app version, device identifiers, and IP address may be collected when you use our app or site. We also collect usage data such as app crash logs, features accessed, and time spent on certain pages. This helps us debug issues and improve our services.
- • Location Data: With your permission, we may collect precise location data from your device. For example, during an SOS alert, knowing your geolocation can be crucial to send help. Also, for location-based services like assigning a nearby pharmacy or lab for you, location info improves accuracy. You will be prompted to grant or deny location access in the app, and you can use the service without granting live GPS access except for SOS (where we will ask explicitly). Even if you don't share GPS, we may derive an approximate location from your address or phone area code to serve you better (this is less precise).
Note: We strictly limit the collection of sensitive data to what is necessary for your care. For example, we might collect information on your physical and mental health condition because it directly impacts telemedicine, but we will not collect data about your political or religious beliefs, or other irrelevant information.
2. How We Use Your Information
We use your personal and sensitive data only for legitimate purposes connected to delivering the ZOKTO services, as outlined below:
2.1 Providing Healthcare Services
- • Doctor Consultations: We use your health information to facilitate teleconsultations. For instance, the symptoms or queries you input are shared with the Doctor so they can advise you properly. The Doctor's notes and prescription are stored and shown to you, and also to the pharmacy if you order medicine. We may analyze consultation data internally (without identifying you) to improve how we connect patients to the right doctor or to assist doctors (for example, an AI tool might highlight potential drug interactions for the doctor's attention, but the final decision is the doctor's – no automated decision-making in clinical care).
- • Lab Test Coordination: When you book a lab test, we use your details (name, contact, address, test required) to schedule the sample pickup and share necessary information with the lab technician (e.g., "Patient is Fasting since 10pm"). We track the status of your test and ensure the results are delivered to you (and to the consulting doctor, if applicable).
- • Medicine Orders: If you order medicines, we use the prescription and your address to arrange fulfillment by a partner pharmacy. Your details are used to generate an order for the pharmacy, who then delivers to you. We also use your phone number to send you order updates (like OTP for delivery or a confirmation call).
- • Emergency Response: If SOS is activated, we use whatever relevant info we have (e.g., your current location, known medical conditions or allergies from your profile, your emergency contact's number) to coordinate help. For instance, we might tell a nearby chemist, "This is for [Your Name], who has triggered an SOS – they may have asthma, please deliver an inhaler to [location]." Only necessary details are shared and only with those aiding in the emergency. In parallel, we might use your info to notify your emergency contact and the on-call doctor.
2.2 Communication
We use your contact information to communicate with you about:
- • Appointments and Reminders: e.g., confirming your doctor appointment, reminding you 15 minutes before a consultation, or notifying you when lab personnel are en route to your home.
- • Service Alerts: e.g., sending OTPs for login, confirming when a prescription is ready, notifying you that your lab report is available, or that your medicine order is out for delivery. If you opt-in, we might also send push notifications within the app for such updates.
- • Customer Support: if you reach out for help, we will use your info to verify your identity and look up your records to assist you. We might follow up with you about an issue until it's resolved.
- • Feedback and Surveys: We may send you requests to rate your experience or provide feedback (e.g., "How was your consultation?"). Responding is optional, but your insights help us improve.
- • Marketing and News (limited): We currently do not sell ads and we will not spam you. With your consent, we may occasionally send informational content like health tips, new features on ZOKTO, or promotional offers on our services. You can opt out of such messages. All communications will respect applicable TRAI regulations on user consent and preferences for receiving promotional messages.
2.3 Improving Our Services
Internally, we may use collected data to analyze and enhance our platform and services:
- • Analytics: We examine usage patterns to understand what features are most used (e.g., lots of users in a particular city booking dermatology consults) and where users face difficulties (e.g., many drop-offs at payment step). This helps us refine the user interface and fix bugs. These analytics are usually done on aggregated data, not focusing on individual identities.
- • Quality Control: We might review certain consultations or chats for quality assurance (for example, our medical director might audit a few cases to ensure doctors are following guidelines). Such reviews are done by authorized personnel under confidentiality. We also monitor for compliance with Telemedicine Guidelines (e.g., that prescriptions are given appropriately).
- • Development of New Features: Data (in aggregated or anonymized form) helps us identify user needs – for instance, if many users ask questions about diabetes, we might introduce a diabetes care program. Or we might use feedback to train automated support chatbots (again, ensuring no personal identifiers are in the training data).
- • AI and Automation: As mentioned, we may employ AI to assist operations – e.g., an AI may automatically sort incoming patient inquiries into categories (billing, medical, technical) to route you to the right support agent faster. We may also use automated language translation to help doctors and patients converse if they choose different interface languages. These uses of AI are overseen by humans, and we do not allow AI to make medical decisions or final judgments without a doctor. All AI usage is intended to comply with ethical and legal standards.
2.4 Legal and Regulatory Compliance
We use your data to ensure we and our partners comply with applicable laws:
- • Record-Keeping: Indian law (and good medical practice) requires maintaining patient records. For example, telemedicine guidelines expect doctors (and by extension, platforms facilitating telemedicine) to keep consultation records for a certain period. We maintain such records securely.
- • Consent and Notice: The DPDP Act requires that we process personal data only after providing you with notice of how we use it and obtaining your consent. This Privacy Policy serves as notice, and your use of our services (with affirmative actions like clicking "Agree" or continuing after reading) is taken as consent for the specified uses. For any new use, we will seek fresh consent.
- • Grievances and Dispute Resolution: If you contact us or authorities about a privacy issue, we will use your data to investigate and resolve it.
- • Compliance with Orders: If we receive a lawful order (court order, government directive under the IT Act, etc.) to disclose certain data, or if required by law (for instance, responding to a notice from a regulatory body), we may use and share data to the minimum extent necessary to comply. Section 72A of the IT Act penalizes anyone (including us) for disclosing personal information without consent in breach of a lawful contract. We will not disclose your personal/sensitive data to government or third parties except in accordance with the law (with consent or due legal process).
- • Preventing Misuse: We may process data to detect and prevent fraud or other misuse. For example, if multiple accounts use the same device in suspicious ways, we might investigate to prevent abuse of free trials or to ensure it's not a bot.
2.5 Other Purposes (with Consent)
If we ever need to use your data for a purpose not covered above, we will ask for your explicit consent. For instance, if we want to feature your success story or testimonial on our website, we would seek your permission. If you later change your mind, you can withdraw such consent.
Importantly: we do not sell your personal data to third-party advertisers or marketing companies. We also do not use your health data to show you third-party ads. Any analytics or research we do is internal to improve ZOKTO's offerings or, if shared externally (like a health trend report), it will be in anonymized form without identifying individual users.
3. Disclosure of Your Information
We share your information only in the ways described below, and always with adequate safeguards:
3.1 With Doctors
When you consult a Doctor via ZOKTO, the Doctor will have access to the information you've provided for that consultation. This typically includes your profile information (name, age, gender), your medical query, past consultation history on ZOKTO, and any uploaded reports or images. This information sharing is obvious and inherent to getting medical care: the Doctor needs your data to advise you. All Doctors are bound by medical ethics, the Telemedicine Guidelines, as well as confidentiality clauses in our agreement with them, to keep your information confidential and use it only for your treatment.
3.2 With Partner Service Providers
Depending on the services you use, we share relevant data with those fulfilling the service:
Laboratories
If you book a lab test, we provide the lab (and their phlebotomist) the necessary details: your name, contact, address, gender, age, and tests requested. We may also share information like whether you are fasting or any relevant clinical notes (with your consent, if needed for test interpretation). The lab needs this to perform the test and report correctly. We also share your phone number so they or the pickup agent can reach you. The lab will eventually generate your report and share it with us (and sometimes directly with you as well). We ensure our partner labs handle this data as per applicable standards.
Pharmacies
If you order medicines, we share your order details with the pharmacy: this includes your name, delivery address, phone, and the prescription details (medicine names, strengths, dosage as prescribed by the doctor). The pharmacy requires this to validate and dispense the medication legally. The delivery person will have your name, address, and phone to deliver the package and may call you. We instruct all our pharmacy partners to treat your prescription data with confidentiality (they themselves are bound by pharmacy practice regulations to keep customer data private).
Emergency Responders
In an SOS scenario, we might reach out to third parties like local emergency services (if available), nearby volunteer responders, or pharmacies for emergency supplies. We will share only what is necessary: usually your first name, location, contact number, and a description of the emergency or needed item. For example, if we contact a local clinic to send help, we'd tell them "27-year-old male at [location] having severe asthma attack, needs assistance." These parties are not our regular service providers but ad-hoc helpers in emergency. We cannot formally guarantee their adherence to privacy, but we communicate that the information is sensitive and only to be used for helping you in that moment.
Service Facilitators
We also use certain vendors to enable our services behind the scenes, and they might process your data on our behalf (under strict contracts). Examples include cloud hosting providers (who store our database), SMS/email service providers (to send OTPs and notifications to you), payment gateway (to process payments), and analytics tools (to analyze app usage). Where these vendors are involved, they act under our instructions and do not have independent rights to use your data. For instance, our cloud provider stores data but cannot peek into it or use it for themselves under our contract. Similarly, an SMS provider might see the phone numbers and message content we send (like OTP codes) but they can't use those for anything except delivering the SMS. We ensure all such third parties are bound by confidentiality and data protection obligations comparable to ours.
In all cases above, we only share information that the third party needs to fulfill their part. They are not allowed to use it for anything else (like labs can't sell your phone number or pharmacies can't use your prescription to market other drugs to you – and if they did, we would take action as it violates our terms with them).
3.3 Within VYSN and Affiliates
Within our own company, access to personal data is restricted to those who need it for their job. For example, the tech team may have access to logs with user IDs to debug issues, but they won't see medical content unless necessary for a technical fix. Our medical panel might review transcripts for quality, but then they are bound by privacy rules. If VYSN in the future has affiliates or subsidiaries involved in delivering ZOKTO services, your data might be shared with them under the same strict conditions outlined here (e.g., if we open a subsidiary in another state to manage local operations, the data might reside in a central database accessible to both parent and subsidiary strictly for service provision).
3.4 Business Transactions
If VYSN (the company operating ZOKTO) undergoes a merger, acquisition, reorganization, or asset sale, your personal data may be transferred as part of that deal. We would ensure that the new entity either continues to follow this Privacy Policy or obtains your consent for any material changes. For example, if a larger healthcare company acquires us, your data would become part of that new organization. They would be bound to use it only in continuity of the service, unless you consent otherwise. We will notify you of any such change in data ownership. If you object to the new owner, you would have the right to request deletion of your data.
3.5 Legal Disclosures
We may disclose personal information if required to do so by law or pursuant to a legal process, or if we in good faith believe that such action is necessary to:
- • Comply with a legal obligation (for example, a court order or a summons, or a government request under applicable law);
- • Protect and defend the rights or property of VYSN (including enforcing applicable Terms of Use or investigating potential violations);
- • Act in urgent circumstances to protect the personal safety of users or the public.
For instance, if law enforcement provides an order to furnish information about a user in relation to an investigation (with proper jurisdiction and legal basis), we are compelled to comply. Another scenario: if a user is misusing the platform for illegal drug procurement, we might voluntarily share information with authorities to prevent harm. In all such cases, we will ensure the disclosure is through proper channels and only what is lawfully demanded. We will also, when possible and lawful, inform you of such disclosures.
3.6 With Your Consent
Apart from the above, if we ever need to share your information with anyone else, we will do so only after obtaining your explicit consent. For example, if you want us to send your medical reports to a doctor outside our platform, we'd do that only with your request. Or if we partner with an external wellness company and you choose to opt-in to their services, we would share your relevant data with them only after you agree to the specific integration and understand their privacy terms. You remain in control of such sharing.
No Unauthorized Disclosure
We reiterate that we do not sell, rent, or trade your personal or sensitive data. We also do not share your health information with advertisers or social media platforms. Any sharing happens in the context of providing you services or when compelled by law. Our employees and contractors are all trained and legally bound to maintain confidentiality. Unauthorised disclosure of health information can also attract penalties under IT Act Section 72A, and we take those obligations seriously.
4. Data Security Measures
We take data security seriously and implement reasonable security practices and procedures as required under the IT Act, 2000 (Section 43A) and follow industry best practices to protect your information. Some of the key measures include:
Encryption
All communication between your app/browser and our servers is encrypted via HTTPS/TLS. Sensitive data (such as health records, personal identifiers, and passwords) is stored in encrypted form in our databases. For example, passwords are hashed and not stored in plain text. If you upload medical images or documents, they are stored securely and transmitted to doctors or you over encrypted channels.
Access Control
Internally, we limit access to personal data to authorized personnel on a need-to-know basis. Different levels of data (general profile vs. health details) have role-based access control. Our doctors access your data through their authenticated accounts on our platform. Our staff may access data to troubleshoot issues or provide support, but only the minimum needed and with strict controls/logging. Every access to personal health data by our team (beyond automated processes) is logged for audit.
Secure Infrastructure
We use reputable cloud service providers who have strong security certifications (like ISO 27001, SOC 2). Our servers are firewall-protected and regularly updated with security patches. We employ intrusion detection and prevention systems. Data is regularly backed up in encrypted form to prevent loss. We also isolate environments (e.g., production data is separated from testing systems to avoid unintended exposure).
Additional Security Measures
- • PCI-DSS Compliance: Our payment processing is outsourced to Razorpay which is PCI-DSS compliant. We never handle your card details directly.
- • Device Security: Our app is built with security in mind. We do not store sensitive info on your device beyond what's necessary.
- • Training and Policies: All employees undergo privacy and security training and adhere to confidentiality policies.
- • Third-Party Audits: We periodically conduct security audits and penetration testing through external experts.
- • Data Minimization: We minimize use of directly identifying data and pseudonymize data where feasible.
- • Breach Response Plan: We have an incident response plan to identify, isolate, and respond to potential breaches.
Important: No system is impenetrable, and we want to be transparent that while we reduce risk to a minimum, we cannot guarantee absolute security of data. Users are also responsible for maintaining the security of their login credentials. Please use a strong password and do not share OTPs or passwords with anyone. If you suspect any unauthorized access, notify us immediately.
5. Data Retention
We retain your personal and health information for as long as necessary to fulfill the purposes outlined in this Policy, or as required by law. How this works in practice:
Active Account
If you have an active account, we will retain your data to provide you services (consultation history, health records for future reference, etc.). Keeping your medical history is beneficial for continuity of care – doctors can provide better follow-up if they know past issues.
Inactive Accounts
If you stop using ZOKTO (no logins or transactions) for an extended period, we may classify the account as inactive. Even then, we generally retain core information for a reasonable time in case you return, unless you request deletion. Health records are often kept for a minimum duration (e.g., Telemedicine Guidelines suggest archiving records perhaps for 3 years). This is also aligned with standard medical record-keeping practices in India.
Closed Accounts
If you choose to delete your account or withdraw consent for us to hold your data, we will delete or anonymize your personal data. However, we may retain certain data even after account deletion:
- • Transaction Records: Basic data about transactions or payments for financial reporting, audits, and tax compliance (as required by law, often 8 years under tax laws).
- • Medical Records: May be retained for a legally mandated period for medico-legal reasons or as long as a malpractice claim could be brought.
- • Backup copies: Data deleted from active systems might persist in encrypted backups until those backups are rotated out.
- • Anonymized Data: We may retain anonymized or aggregated data indefinitely for analytics and improvement purposes.
Summary: we keep your data only as long as necessary. If laws require retention, we follow that. We also periodically review and delete data that is no longer needed. When we say delete, we mean we will securely and permanently erase personal identifiers so that the data can no longer be associated with you.
6. Your Rights and Choices
Under Indian law (including the DPDP Act, 2023), you have rights regarding how your personal data is handled. We have structured our processes to honor these rights:
Right to Access
You have the right to confirm whether we are processing your personal data and to access such data. Through the ZOKTO app you can see much of your data directly: your profile details, consultation history, prescriptions, lab reports, etc. If you need a structured copy of your personal data, you can request it from us. We will ask you to verify your identity before providing such information to ensure privacy.
Right to Correction
If you find that any personal data we have is inaccurate or incomplete, you have the right to request a correction. Some basic info can be edited directly in-app (like address, phone). For health records, if you spot an error in a medical detail, you can contact us – we may coordinate with the doctor to append a correction note. We strive to keep data accurate and will update it as per your instructions after verification.
Right to Erasure
You may request deletion of your personal data in certain circumstances. If you no longer want to use ZOKTO and want all your records removed, you can write to us to delete your account. We will delete the data that we are not obligated to retain. Some data, as explained in retention, we might keep for legal reasons. Do note that erasing health data means we (and you via our platform) will no longer have access to your past records on ZOKTO – so ensure you have copies of any reports or prescriptions you might need before requesting full deletion.
Right to Withdraw Consent
To the extent our processing of your data is based on consent, you have the right to withdraw that consent at any time. For instance, if you gave consent to share data with a particular partner or to receive promotional messages, you can revoke it. Using our core services is taken as consent for service-related uses of sensitive data. If you withdraw consent for core uses, we might have to deactivate your services because we cannot provide care without processing your health info.
Additional Rights
- • Right to Data Portability: You can download your reports and records from our app. We can provide machine-readable exports if required for porting to another system.
- • Right to Grievance Redressal: You have the right to lodge a complaint with us and have it addressed through our Grievance Officer.
- • Right to Nominate: The DPDP Act allows you to nominate another individual to exercise your rights in the event of death or incapacity.
- • Managing Communication Preferences: You can choose what communications you receive from us, with essential communications remaining mandatory for service delivery.
To exercise any of your rights, you can use in-app settings where available or write to us at privacy@vysn.in or info@zokto.in. We may need to verify your identity and will respond within the timeframe required by law. We want you to feel in control of your data, and our team is dedicated to upholding these rights.
7. Children's Privacy
As per our Terms of Use, individuals under 18 are not allowed to use ZOKTO independently. We do not knowingly allow minors to register or use the services without verifiable parental consent.
For Minors Using ZOKTO via Parent/Guardian
If you, as a parent or legal guardian, use ZOKTO to consult for or manage the care of a minor child, we treat the consent for data collection and processing as given by you on behalf of the child. Under the DPDP Act, the parent/guardian is recognized as the "Data Principal" for the child's data. This means the parent/guardian can exercise the child's data rights on their behalf. We limit data collection for minors to what is necessary and do not directly market to children.
Data Protection for Minors
- • We record only necessary information like the child's name, age, gender, health issues as provided by the guardian
- • This data is protected with the same or stricter care as adult data
- • We do not display or share a minor's data except with consulting doctors and relevant service providers
- • We do not collect additional personal data from children beyond what the guardian provides for healthcare
- • We do not let a minor directly communicate without guardian oversight
Unauthorized Minor Use
If we become aware that we have collected personal data from a child under 18 without parental consent (for example, if a 16-year-old misrepresents their age to use the service alone), we will deactivate the account and delete such data promptly. If you believe a minor is using ZOKTO improperly, please contact us so we can investigate and take appropriate action.
8. Cross-Border Data Transfer
Currently, we primarily store and process data on servers located within India. We understand that health data is sensitive, and many users and regulators prefer local storage.
Limited International Transfer
However, some of our service providers or technical solutions might involve data transfer outside India. For example:
- • Email services whose servers are in other countries for sending you notifications
- • App analytics providers that might store aggregated usage stats on servers outside India
- • Consultation data viewed by foreign doctors (with necessary Indian telemedicine registration)
Legal Compliance
The DPDP Act (2023) permits cross-border transfer of personal data to all countries except any that may be restricted by the government. We ensure that any overseas transfer is done securely and in compliance with law by choosing service providers in jurisdictions with strong data protection laws or requiring them to sign contracts with robust data protection clauses.
Your Preferences
If you specifically prefer that your data never leaves India, please let us know – we can try to accommodate by keeping your data solely on Indian servers, although it might limit some functionality. We'll be transparent in such communication. Our default is local storage, and any cross-border transfer is incidental or for redundancy/performance.
9. Updates to this Policy
We may update this Privacy Policy from time to time. Reasons could include:

We encourage you to review this Privacy Policy periodically to stay informed. Continuing to use ZOKTO after a change signifies acceptance of the revised policy. If you do not agree to the changes, you should stop using the services and can request deletion of your data. We keep earlier versions of this Privacy Policy archived and can provide them on request for transparency.

We will acknowledge your complaints within 24 hours of receipt and resolve them within 15 working days or as prescribed by applicable regulations. If for any reason the resolution takes longer than expected, we will keep you informed about the progress and expected timelines.
Escalation
If you are not satisfied with our resolution, you can escalate the matter. The DPDP Act contemplates a Data Protection Board of India for oversight. Once established, you can file a complaint with the Board if you believe we have not complied with the law or resolved your grievance adequately. We sincerely hope to resolve issues directly and maintain your trust.
